Terms of Use
1. INTRODUCTION AND ACCEPTANCE
These Terms of Use ("Terms") govern your access to and use of the Binexus Power BI Hub Portal ("Platform" or "Software"). The Platform is a business intelligence-based reporting tool that offers features such as Keycloak-based authentication, multi-tenant architecture, RLS (Row Level Security) supported security model, and timed reporting, enabling organizations to share Power BI reports in a centralized, secure, and manageable environment.
By accessing, registering, or using the Platform, you agree to be legally bound by these Terms. If you do not accept these Terms, you must not use the Platform.
2. DEFINITION AND SCOPE OF THE PLATFORM
Binexus provides the following core capabilities to its users:
• Multi-Tenant Architecture: Enabling different organizations to operate in isolation on the same infrastructure.
• Authentication and Security: Local authentication based on Keycloak and Single Sign-On (SSO) support via Microsoft Entra ID (Azure AD) integration.
• Report Management and Viewing: Centralized management, editing, and viewing of reports via Power BI API integration.
• Advanced Security (RLS): Row Level Security allowing users to see only the data they are authorized to access.
• Timed Reporting: Automatic export and sharing of reports in PDF format at designated intervals.
• Secure Sharing: Creation of time-limited and password-protected links for external users.
• Logging and Auditing: Detailed recording of all user activities and report access on the system.
3. USER OBLIGATIONS
Users agree to the following rules when using the Platform:
• Use the Platform solely for lawful and authorized purposes.
• Maintain the confidentiality and security of login credentials (username, password, etc.). All responsibility arising from unauthorized use of the account belongs to the user.
• Not to subject the Platform to reverse engineering, copying, modifying, or attempting to access the system’s source code.
• Not to use the Platform for providing unauthorized third-party services, as a service bureau, or for processing data on behalf of external customers.
• Not to attempt any actions to breach, bypass, or create vulnerabilities in the system’s security.
4. LICENSE GRANT AND INTELLECTUAL PROPERTY
Binexus grants the user a limited, non-exclusive, non-transferable, and non-sublicensable right to use the Platform for the user’s internal business processes. This license does not imply transfer of ownership of the software.
All intellectual property rights including copyrights, trademarks, designs, trade secrets, on the Platform’s codes, interfaces, designs, data models, algorithms, documentation, brand, and all other components belong to Binexus (or relevant right holders). The user cannot claim any ownership rights on the Platform.
5. DATA PROTECTION AND PRIVACY
Binexus processes user data in accordance with Law No. 6698 on the Protection of Personal Data (KVKK) and related legislation. Users are solely responsible for the legality, accuracy, and obtaining necessary explicit consents from relevant persons regarding the data they upload to or process through the Platform. In most cases, Binexus acts only as a "Data Processor."
6. SERVICE LEVEL AND INTERRUPTIONS
Binexus aims to operate the Platform with high availability (SLA-based) but does not guarantee uninterrupted service. Planned or unplanned interruptions may occur due to maintenance, infrastructure updates, force majeure, or causes originating from third-party service providers (e.g., internet service providers, cloud infrastructures).
7. FEES AND PAYMENT
Certain features, modules, or usage capacities of the Platform may be subject to subscription or license fees. The user is obliged to pay the determined fees on time. In case of late payment, Binexus reserves the right to suspend or terminate the user's access to the Platform.
8. LIMITATION OF LIABILITY
Binexus shall not be held liable for indirect damages, data loss, loss of profits, or business interruptions arising from the use or inability to use the Platform. Binexus’s total financial liability is limited to the total fees paid by the user for the Platform in the last 12 months.
9. SUSPENSION AND TERMINATION
In case of the user’s violation of these Terms, engagement in illegal activities, or failure to fulfill payment obligations, Binexus may suspend or terminate the user’s account and access to the Platform without prior notice. Upon termination, the user must immediately cease using the Platform.
10. APPLICABLE LAW AND COMPETENT COURTS
These Terms are governed by the laws of the Republic of Turkey. The Istanbul Courts and Enforcement Offices shall have jurisdiction for the resolution of any disputes arising from these Terms or the use of the Platform.
11. AMENDMENTS
Binexus reserves the right to update or amend these Terms from time to time. Significant changes will be notified to users via the Platform or by email. Continuing to use the Platform after changes indicates acceptance of the updated Terms.
